Terms of Service

Who can use the Service

• You must be at least 18 years old, or the age of legal majority where you live, to create an account.
• Player profiles for children may be created and managed by their parents, legal guardians, coaches, or team managers — not by the children themselves.
• You agree to provide accurate account information and keep it up to date.
• You're responsible for keeping your password secure and for everything that happens under your account.

Roles on a team

The Service supports several roles, each with different access:

• Coaches and team managers can create teams, manage rosters, post messages and events, upload media, and invite parents.
• Parents can RSVP, view their child's information, see team messages and media, and chat with the team. Parents always use the Service for free.
• Club admins can manage multiple teams under one club and view financial reporting.

Subscriptions, billing, and refunds

Coach and club features require a paid subscription. Parents always use the Service for free.

Plans

• Coach Annual: $99/year. Includes a 7-day free trial. No charge during the trial. Cancel anytime before the trial ends to avoid being billed.
• Coach Monthly: $10/month. Includes a 7-day free trial. Cancel anytime.
• Founder Rate: $5/month, billed monthly, for the first 50 coaches to sign up. Once your subscription is active, the $5/month rate is locked for as long as you maintain the subscription without lapse. If you cancel, you cannot return to the Founder Rate even if the program is still open.
• Club: $299/year base. The subscription fee is waived for any annual period in which your club processes at least $15,000 in registration payments through GoalKickr's payment processor (Stripe). The waiver is reconciled at renewal: if you meet the threshold, the renewal charge is refunded as an account credit within 30 days. The initial $299 is charged upfront.
• Club Pro: $499/year flat, regardless of club size. Integrations and advanced reporting roll out as they ship.
• Video storage add-on: +$10/month, added to a Coach plan at checkout. Cancellable independently.

Billing

All payments are processed by Stripe. By subscribing, you authorize GoalKickr (via Stripe) to charge your payment method on the renewal date of each billing cycle until you cancel. Prices are in U.S. dollars and exclude any taxes that may apply.

Cancellation

You can cancel any subscription at any time from the Stripe customer portal linked in the App's Settings. Cancellation takes effect at the end of the current billing period — you keep access until then.

Refunds

We do not generally offer refunds for partial billing periods. We will refund a charge in the following cases:

• You were charged after cancelling and your cancellation was timely.
• You were billed for a Club annual fee that should have been waived under the $15,000 threshold (handled as an account credit within 30 days of renewal).
• A duplicate or accidental charge occurred.

Price changes

We may change subscription prices for new signups at any time. Existing subscribers will be notified by email at least 30 days before any price increase takes effect on their account. Founder Rate subscriptions are exempt from price increases as long as the subscription remains active without lapse.

Acceptable use

You agree NOT to use the Service to:

• Harass, threaten, bully, or harm any person, including teammates, parents, coaches, or referees.
• Upload content that is unlawful, obscene, defamatory, discriminatory, or that infringes another person's rights.
• Upload media of children without the consent of their parent or guardian.
• Send spam, mass-marketing messages, or unsolicited bulk communications through team chat or messaging features.
• Attempt to access another team's data, reverse-engineer the Service, scrape data programmatically, or interfere with the operation of the Service.
• Resell, sublicense, or commercially exploit the Service except as expressly permitted by your subscription.
• Use the Service to violate any applicable law, including youth-protection, anti-discrimination, or data-protection laws in your jurisdiction.

We may suspend or terminate any account that violates these rules, and may remove content that violates these rules without notice.

Your content

You retain ownership of the content you upload to the Service (team messages, photos, videos, player records, schedules, etc.). By uploading content you grant GoalKickr a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and otherwise process that content solely to operate and improve the Service.

When you generate a share link (for an event, photo, video, vote, or similar), anyone with that link can view (and in some cases respond to) the linked item without signing in. You're responsible for who you share those links with.

When you upload media of children, you confirm that you have the right to do so — either as the parent or legal guardian of those children, or with their parent or guardian's consent.

Player data and youth protection

The Service is designed to manage real-world youth sports teams, which means coaches and parents enter information about minors (names, dates of birth, jersey numbers, emergency contacts, optional medical notes, photos, and videos). GoalKickr acts as the data processor for this information; the coach, team manager, or club is the data controller and is responsible for obtaining any consents required under applicable law (including COPPA in the United States and GDPR-K in the European Union).

By creating or managing player profiles, you represent that you have the legal right to do so for each player on your team.

Third-party services

The Service relies on third-party providers to operate (Firebase, Cloudflare, Stripe, Apple, Google). Their terms and privacy policies apply to the parts of the Service they provide. If a third-party provider becomes unavailable, corresponding features of the Service may be unavailable as well.

Beta and early features

Features labeled as "beta," "preview," "rolling out," or similar are provided as-is and may change, break, or be removed without notice. Don't rely on beta features for mission-critical workflows.

Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We don't warrant that the Service will be error-free or that defects will be corrected.

Limitation of liability

To the maximum extent permitted by law, GoalKickr and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of the Service.

Our total cumulative liability to you for any claims arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify and hold harmless GoalKickr, its operators, employees, and contractors from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) content you upload or share through the Service, or (d) your violation of any law or third-party right.

Termination

You can stop using the Service at any time by cancelling your subscription and, optionally, requesting deletion of your account by emailing support@goalkickr.com.

We may suspend or terminate your account at any time if you violate these Terms, if your account creates legal or operational risk to the Service, or if your subscription lapses for non-payment. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (ownership, disclaimers, liability limits, indemnification, governing law) will survive.

Changes to these Terms

We may update these Terms as the Service evolves. If we make a material change, we'll update the "Effective" date above and, where appropriate, notify you in the App or by email. Continued use of the Service after a change means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts.
